TERMS AND CONDITIONS OF SERVICE

- Definitions and Interpretation
1.1. In these Terms and Conditions, unless the context otherwise requires:
- “Business” means Bold and Personal Designs its employees, agents, and contractors.
- “Client” means the person or entity who engages the Business for interior design services.
- “Services” means the interior design services provided by the Business, as set out in the Proposal, Contract, or Website.
- “Deliverables” means all concepts, drawings, mood boards, schedules, product lists, and related documentation prepared for the Client by the Business.
- “Agreement” means the contract between the Business and the Client incorporating these Terms.
1.2. Headings are for convenience only and do not affect interpretation.
- Engagement of Services
2.1. The Client agrees to engage the Business to provide Services as outlined in the agreed package or scope of work.
2.2. Upon payment of a deposit or signing of an agreement, the Client confirms acceptance of these Terms.
- Scope of Services
3.1. The Business provides the following services (as selected by the Client):
- Full-Service Interior Design
- DIY Custom Shopping List
- Space Planning & Layout Design
- Finishes & Fixtures Schedules
- Colour Scheme Consultation
3.2. Details and inclusions for each service are provided on the Business’s website and/or within a service agreement or project proposal.
- Consultations
4.1. The Business offers a complimentary 15-minute consultation by phone to discuss the Client’s needs and recommend services.
4.2. Paid consultations are in-depth sessions via video or in person and are chargeable as specified. These include design advice and direction tailored to the Client.
- Fees and Payment Terms
5.1. The Client agrees to pay the Business fees as follows:
- $75 per hour
- 5.2. A 50% deposit is payable before work commences. The balance is due upon delivery of the final design or as otherwise agreed.
5.3. Additional services or work outside the agreed scope will be charged at the Business’s standard hourly rate of $75 unless otherwise stated.
5.4. Payments must be made within 7 days of the invoice date. Late payments may incur a fee of 5% per month overdue.
- Revisions and Scope Variations
6.1. Each service includes a specified number of revisions, as outlined in the proposal or service agreement.
6.2. Additional revisions, redesigns, or changes outside the agreed scope are chargeable at the Business’s hourly rate.
6.3. Any delay by the Client in approving or responding to revisions may impact delivery timelines.
- Intellectual Property
7.1. All Deliverables remain the intellectual property of the Business until full payment is received.
7.2. Upon full payment, the Client is granted a non-transferable, non-exclusive licence to use the Deliverables solely for personal, non-commercial purposes.
7.3. The Client may not duplicate, reproduce, or distribute Deliverables without written consent.
- Procurement and Third-Party Products
8.1. The Business may assist the Client in sourcing products. However, the Business does not guarantee the availability, delivery times, or performance of third-party suppliers.
8.2. The Client is responsible for all purchases made directly or indirectly with external vendors.
- Collaboration with Trades
9.1. Where applicable, the Business will liaise with trades or builders to support design implementation.
9.2. The Business accepts no responsibility for workmanship, contractor performance, or delays caused by third parties.
- Cancellations and Refunds
10.1. Cancellation of a paid service must be made in writing with a minimum of 48 hours’ notice. Cancellations made within 48 hours may incur a cancellation fee.
10.2. Prepaid services not yet commenced may be eligible for a partial refund at the Business’s discretion.
10.3. No refunds are available for completed work or consultations once delivered.
- Limitation of Liability
11.1. The Business shall not be liable for any indirect, incidental, or consequential losses arising from the use of the Services.
11.2. To the maximum extent permitted by law, the total liability of the Business in connection with this Agreement shall be limited to the amount paid by the Client for the Services.
11.3. The Client agrees to indemnify and hold the Business harmless against all claims, liabilities, damages, and costs arising from third-party suppliers, trades, or contractors engaged by the Client.
- Termination
12.1. Either party may terminate this Agreement by written notice if the other party breaches a material term and fails to remedy it within 14 days.
12.2. On termination, all outstanding fees for services rendered up to the date of termination shall become immediately payable.
- Governing Law and Jurisdiction
This Agreement shall be governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
- Acceptance of Terms
By engaging the Services of Bold and Personal Designs PTY LTD you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
